Chinese
Promulgated by the Ministry of Labor Order No. Lao-Dong-Guan-2-Zi-1150142541 on June 26, 2026; the full text consists of five articles and shall enter into force on July 21, 2026 pursuant to Article 5.
Article 1 The Regulations are prescribed in accordance with Paragraph 4 of Article 8 of the Delivery Workers' Rights Protection and Delivery Platform Management Act (hereinafter referred to as the “Act”)
Article 2 When a delivery worker terminates a delivery service contract in accordance with Paragraph 1 of Article 8 of the Act, the delivery platform operator shall make a lump-sum payment of economic compensation based on the delivery worker's length of service, up to a maximum of six months of average remuneration. The standards for such compensation are as follows:
I. One-half month of average remuneration for each full year of service.
II. For a period of service of less than one year, compensation shall be calculated proportionately.
The term “length of service” referred to in the preceding paragraph means the delivery worker's total hours actually spent providing delivery services from the date on which the delivery service contract was concluded through the date on which the contract is terminated in accordance with Paragraph 1 of Article 8 of the Act. The total hours shall be divided by eight hours per day to calculate the number of days of service, and the resulting number of days shall then be divided by 245 days to calculate the length of service. Any period of less than one hour shall be counted as one hour, and any period of less than one day shall be counted as one day.
The term “average remuneration” referred to in Paragraph 1 means the amount obtained by dividing by six the total remuneration received by the delivery worker during the six months preceding the date on which the delivery service contract is terminated in accordance with Paragraph 1 of Article 8 of the Act. Where the delivery worker has provided services for less than six months, average remuneration shall be calculated by dividing the total remuneration received during the effective period of the delivery service contract by the number of days in that period and multiplying the result by thirty. Any fractional amount shall be rounded up to the next whole number.
Article 3 A delivery platform operator shall pay the economic compensation within sixty days after the delivery worker terminates the delivery service contract in accordance with Paragraph 1 of Article 8 of the Act.
Article 4 Economic compensation paid by a delivery platform operator in accordance with Paragraph 3 of Article 8 of the Act shall be remitted to the financial institution account designated by the delivery worker or paid by any other means of payment permitted by law.
Article 5 These Regulations shall enter into force on July 21, 2026.
