Article 1
These measures are promulgated according to Item 3 of Article 58<br />in the Handicapped Protection Law (herein as the Law).
Article 2
The competent authorities refered in this measure are the labor<br />administration competent authorities of all levels.
Article 3
The competent authority shall combine private resourses to establish<br />the employment Service institutions for the handicapped through the <br />following methods: <br />1.Partial assistance of the budget.<br />2.Lease or loan of the service locations with pay or without pay.<br />3.Lease or loan of the equipment with pay or without pay.<br />4.Technical assistance.
Article 4
The competent authority combining private investment resources in<br />the establishement of the employment service institutions, shall do all <br />according to the stipulated in Article 59 of this Law.
Article 5
The employment service institutions for the handicapped, shall<br />install the following professionals according to the needs of the operation: <br />1.Case managers<br />2.Employment service staff<br />3.Employment assistance evaluation staff<br />4.Employment assistance tool service staff<br />The qualifications and number of the aforementioned professionals, shall be <br />processed according to the regulations stipulated in the recruitment and <br />training of the employment service institutions for the handicapped and the <br />measures of the emploment service institutions.
Article 6
The employment service institutions for the handicapped shall<br />provide the following indivualized employment services according to the <br />operation characteristics:<br />1.Case management of the employment service for the handicapped.<br />2.Community employment service for the handicapped.<br />3.Supportive employment services for the handicapped.<br />4.Expand employment opportunities for the handicapped.<br />5.Work analysis and profession analysis for the handicapped.<br />6.Employment assistance evaluation for the handicapped.<br />7.Employment readjustment.<br />8.Employment assistance tool services.<br />9.Employment adapataion assistance and training.<br />10.To establish transfer system, accepting transferred individual case.<br />11.Human resources services.<br />12.Other related issues helpful for the employment for the handicapped.
Article 7
When the competent authority is combining private investment<br />resources to establish employment service institutions for the handicapped <br />according to Article 3, they shall publish the item and take applications<br />publicly.
Article 8
The employment service institutions for the handicapped in combining<br />establishement, shall apply to the competent authority for the establishement,<br />and present the following documents:<br />1.Project plan.<br />2.Planning meeting minute, including agreed motion of application and the<br /> draft of the institution organization charters or donations.<br />3.Names and education of the planning staff.<br />4.All other documents required by the competent authority.
Article 9
The employment service institutions for the handicapped, when<br />applying for the allowances from the government for the employment services <br />for the handicapped, shall present the following documents:<br />1.Project plan<br />2.Registry certificate and copy of the legal person registry<br />3.Donation chater or organization charter<br />4.Meeting minutes of the decision for application from the meeting of the<br /> board of directors or the members (representatives)<br />5.Gross calculations, final calculations and service performance records of<br /> the last two years<br />6.Organization and task force<br />7.List of employment service professionals<br />8.Location and infrastructure<br />9.All other documents required by the competent authority.
Article 10
The project plan required in the previous two articles shall<br />include the following:<br />1.Name of the applicant<br />2.Project objectives<br />3.Service subject, number and qualifications.<br />4.Content, methods and flow plan of the services<br />5.Performance estimate<br />6.The applicant’s own budget, infrastructure and related equipment.<br />7.Calculation chart of the budget income and expenditure<br />8.Distribution of the professionals<br />9.All other documents required by the competent authority<br />The employment service institutions for the handicapped who apply for the <br />combined establishement, shall provide the plan stating the lease and loan <br />of the equipment stipulated in the aforementioned Item 4.
Article 11
For the applications regulated in Article 8 and Article 9, the<br />competent authority shall revise the following issues:<br />1.Health organization and financial system<br />2.Service performance and professional capability<br />3.Project contents and level of coordination with the policies for the<br /> employment of the handicapped.<br />4.Project feasibility and organization execution capability<br />5.Administration management capability<br />6.Analysis of cost and profit<br />As to carry out the aforementioned task, the competent authority must set up a<br />revision team, the members must include the following:<br />1.Representatives from the competent authority and related institutions<br />2.Representatives from the welfare institutions or groups of the<br /> handicapped.<br />3.Experts and scholars related to the project in application<br />4.Social justice defenders
Article 12
The employment service institutions for the handicapped, approved<br />for allowances or for combined establishement, shall execute the project <br />according to the plan, using the assistance Budget as the combined <br />establishement, the competent authority shall sign a written contract with the<br />institution, should the execution not be carried out according to the plan, <br />the contract shall be terminated.
Article 13
The employment service institutions for the handicapped approved<br />for combined establishement or allowances, the funds expenditures must be <br />recorded in details and in a separate file.<br />The competent authority shall request for the submision of the operation and <br />financial reports any time, or send auditors.<br />Those who are found not performing satisfactorily, the competent authority <br />shall issue a notification notifying the deadline for improvement, those who <br />do not comply, the allowances shall be redeemed or terminated.
Article 14
The competent authority shall reward the employment service<br />institutions for the handicapped which perform satisfactorily accordingly.
Article 15
Resources of the fund for this measure originate from the<br />following: <br />1.Payable from the employment fund for the physically and mentally<br /> challenged.<br />2.Payable from the employment fund for the visually challenged.<br />3.Allowance from the local government.<br />The central competent labor authorities shall provide the allowance <br />according to the financial situation of the district.
Article 16
These measures shall take effect on the day of promulgation.
