Article 1
These measures are promulgated according to Item 3 of Article 29<br />in the Handicapped Protection Law.
Article 2
The competent authorities referred to in this measure are the<br />labor administration competent authorities of all levels.
Article 3
The employment assistant equipment (herein as the equipment)<br />referred to in this measure means the equipment which recuperate, maintain <br />or strengthen the employment abilities of the handicapped.<br />Should the aforementioned equipment be a computer, it shall include all the <br />necessary software applications required for the worker to perform the job.
Article 4
All the necessary equipment required for the participation of the<br />handicapped in the vocational training or employment center, the purchase, <br />manufacture, lease and refurbishments, among other expences, can be applied <br />for the allowance by the handicapped, the tranining institution or the <br />employer according to this measure.<br />Public constructions, activity areas and public transportation means, <br />infrastructure not adequate for the handicapped, and parts which must be <br />improved actively, stated in Item 3 of Article 56 in this Law, are not<br />applicable for the allowance.
Article 5
The employing entity which is the recipient of the allowance of this<br />measure, shall report to the public employment service authority when the <br />position becomes available within two years of the allowance received.<br />When the public employment service authority is unable to recommend a <br />handicapped worker with the same handicaps within seven days after the <br />employer has reported, the employer may hire the suitable person at will.
Article 6
The Council of Labor Affairs of the Executive Yuan shall collect all<br />the related information regarding the employment assistance equipment, as <br />reference for the welfare authorities, groups of the handicapped, or the <br />private persons.
Article 7
As to carry out this measure, registered handicapped employment<br />service authorities, the handicapped welfare groups or the related <br />professional groups can be assigned by the competent authorities to apply <br />for the assistance equipment allowance.<br />For the review of the equipment allowance application, an assessment team <br />shall be formed by the competent authority, in which the members shall include<br />equipment technicians, occupational counseling evaluators, employment sevice <br />administrators, case management specialists, occupational therapists, <br />physiotherapists or other relevant professionals.
Article 8
Resources of the fund for this measure originate from the following:<br />1.Payable from the employment fund for the physically and mentally<br /> challenged.<br />2.Payable from the employment fund for the visually challenged.<br />3.Allowance from the local government.<br />The central competent labor authorities shall provide the allowance <br />according to the financial situation of the district.
Article 9
The applicant with false information or who has not carried out<br />the allowance approved accordingly, shall return the amount of the original <br />allowance.
Article 10
These measures shall take effect on the day of promulgation.
