Article 1
These measures are promulgated according to Article 11 in the<br />Employment Service Act.
Article 2
Those private employment service institutions, vocational training<br />institutions, groups or individuals, which have provided special contributions<br />or with outstanding performances to the following works, can apply for <br />selection: <br />1. Those which take care of the employment matchmaking activities.<br />2. Those which provide employment services to the specified subjects.<br />3. Those which provide individual employment service assistance and <br />counseling.<br />4. Those which promote other activites related to the national employment.
Article 3
When processing the outstanding performance selection and rewards,<br />the competent authorities shall publish the rewarding subjects, the activities<br />rewarded, numbers of candidates, selection items, score distribution standards<br />and the application deadline.<br />The competent authorities can contract relevant institutions (institutes) to <br />process the aforementioned selection items.
Article 4
Those which meet the requirements for the aforementioned public<br />notice, shall present the following documentations to apply for the <br />selection to the competent authorities or contracted institutions (institutes)<br />1. Application form.<br />2. All the documentation with the outstainding events, which meet the <br />rewarding items of the year in process.<br />3. All other documentations required by the competent authorities.
Article 5
When there is an incomplete set of documentations required for<br />selection, the competent authorities or the contracted institutions (<br />institutes) shall notify the applicant to complete the documentations within <br />one month, should the deadline not be met, the application will not be <br />processed.
Article 6
Those applying for the selection, if found to have violated and<br />punished by the labor laws within one year before the application deadline, <br />cannot participate in the selection.
Article 7
Should the application documentations be found untruthful, the<br />application is not processed, and the applicant shall not be admitted for <br />the following three selections for the same reward issues.
Article 8
The competent authorities or the contracted institutions (<br />institutes), when planning for the outstanding performace selection for the <br />national employment promotion, they shall set up a selection committee, with <br />the following missions: <br />1. To be in charge of the selection of the outstanding performance for the <br />national employment promotion.<br />2. To be in charge of the auditing of the outstanding performance for the <br />national employment promotion.<br />3. To discuss and implement the outstanding performance evaluation items and <br />score distribution standards stated in Article 3. <br />4. To be in charge of all other evaluationa and selection issues.
Article 9
The one chairman for the evaluation and selection committee shall be<br />assigned by the competent autorities. There shall be 8 to 12 persons acting as<br />committee members, assigned and contracted by the competent authorities, the <br />posts are as the following:<br />1. 2 to 3 representatives from the competent authorities.<br />2. 3 to 4 representatives from the employment service institutions (<br />institutes) and vocational training institutions.<br />3. 3 to 5 experts and scholars whose work is related to the outstanding <br />performce for the national emlpoyment promotion.<br />The aforementioned committee members do not enjoy wages. During the <br />selection period, evalutation fees, presentation fees and transportation <br />fees will be paid according to the rules.
Article 10
When the evaluation committee chairman, for any reason, cannot be<br />present, the chairman shall assign a committee member to preside over the <br />meeting; when there is no one assigned by the chairman, the replacing chairman<br />shall be elected among the committee members. When the evaluation members <br />cannot be present, except when those members are experts and scholars, the <br />assigned person shall be assigned by letter.<br />The meetings can only begin when there are more than ? of the committee <br />members present. The motions shall be agreed by more than ? of the member <br />present in the meeting, when there is a tie, the chairman shall decide the <br />verdict.
Article 11
The selection committee shall evaluate the documentations presented<br />by the applicants and decide the final list of candidates. During the <br />evaluation, when deemed necessary, the committee members shall visit the <br />sites.
Article 12
Should one of the following situations occurs , the evaluation<br />committee member shall retire automatically: <br />1. Applicant is him/herself, or his/her spouse, former spouse, blood relations<br />in the fourth degree, or political relations in the third degree.<br />2. Has participated in the promotion of the participating application for <br />rewards.<br />3. With concrete facts that recognize the evaluation has shown biases.
Article 13
Those who are considered with the outstanding performance in the<br />national employment promotion, the competent authorities shall reward them <br />publicly. The competent authorities shall reward such persons with the <br />following manners:<br />1. To give a reward plate (certificate) or reward board.<br />2. To give reward money or other prizes with equal value.<br />3. All other methods which appreicate the performance and honor.
Article 14
The rewards and presentation ceremony stipulated in this rue, shall<br />be processed by the competent authorities with their own budget.
Article 15
Those who have already received the rewards stipulated in this<br />rule, shall not be able to repeat the application for the same activity.
Article 16
Those who have received the reward for the outstanding<br />performance for the national employment promotion, should they be found to <br />have violated the rules stipulated in Article 6 or Article 7, shall have their<br />award revoked, and shall not be admitted to participate the following three <br />selections for the same work.
Article 17
The forms and formats are set up by the central competent<br />authorities.
Article 18
This measure shall take effect on the day of promulgation.
