These revised directions are drafted to assist the Ministry of Labor (hereinafter MOL) review applications for work permits by the adult children (hereinafter the applicants) of foreign professionals employed in a professional capacity in Taiwan, foreign special professionals or foreign senior professionals, with a permanent residence permit or Republic of China nationality,pursuant to the provisions of Article 15 and Article 26 of the Act for the Recruitment and Employment of Foreign Professionals(hereinafter the Act).

When the National Immigration Agency (NIA) under the Ministry of the Interior determines that the applicant meets one of the following conditions (residence conditions), he or she can apply to the MOL for a permit to work in Taiwan with no need for an employer to submit an application, pursuant to the provisions of Article 15 and Article 26 of the Act:
(1)Has resided legally in Taiwan for a total of 10 years or more and spent over 270 days each year in the country.
(2)Arrived in Taiwan under the age of 14 and spent more than 270 days each year in the country.
(3)Was born in Taiwan and has resided here legally for a total of 10 years or more, spending over 183 days each year in the country.

When applying to the MOL for a work permit applicants must provide the following documentation by online applying. Applicants with a legitimate reason is exempted.
(1) Application form (see attached document).
(2) Documentation from the NIA confirming the applicant meets at least one of the residence conditions. This is not necessary when the MOL can check information online with another government agency (institution).
(3) Photocopy of the permanent resident certificate or nationalization documents of the father or mother (stamped “copy conforms to the original”).
(4) Photocopy of the applicant’s passport or Alien Resident Certificate (stamped “copy conforms to the original”).
(5) Documentary proof of the kinship relationship to the applicant’s mother or father.
(6) Original receipts indicating payment of the review fee.

Applications for the reissue of a work permit must include the following documentation by online applying. Applicants with a legitimate reason is exempted.
(1) Application form.
(2) Affidavit explaining reason for reissue.
(3) Original receipts indicating payment of the review fee.

In the following situations applicants will be denied a work permit:
(1) Where they do not meet the conditions detailed in Article 15 or Article 26 of the Act.
(2) Where an applicant does not meet the conditions detailed in the review directions and when asked to provide additional information but fails to do so within the designated time period.

When the documents submitted by the applicant are in a foreign language he or she should provide Chinese language translations, other than where additional legal provisions exist.
