Chapter I General Principles
Article 1
This regulation is drafted in accordance with the paragraph 3, of Article 33 of the Vocational Training Act. (hereinafter referred to as the Act)
Article 2
The standards of the paragraph 3,of Article 33 of the Act include the related matters of Skills Certification, classes of Skills Certification, work items, trades of skills, standards of skills and related knowledge of skills, and they can be the reference and coverage for composing exam for written test and field test.
Chapter II Development of Trades
Article 3
The National Competent Authority should initiate the development and adjustment of trades for Skills Certification by referencing the policies of national economic development, cooperating with the trend of industry development and the needs of employment market.
The previous paragraph development and adjustment of trades for Skills Certification can delegate the related institutes and organization to transact.
Article 4
If having one of the following incidents, the National Competent Authority should initiate the development and adjustment of trades for priority:
1. It needed to hire the technicians in accordance with the rules and regulations.
2. Its technique relates to the public safety.
Article 5
If having one of the following incidents, the National Competent Authority should not initiate the development of trades:
1. It needed to be included in professional occupations and technologist examinations.
2. It should be initiated by the Competent Authorities for Business Objectives in accordance with the rules and regulations.
3. Its knowledge and technique still lack of the standards of objective evaluations.
Article 6
The related professional organizations and institutes can pose suggestion and recommendation of the development and adjustment of trades for Skills Certification.
The suggestion and recommendation should include the written data of title of the trade, reason for development, expected effectiveness, supply and demand of manpower in labor markets, work coverage of the trade and major work items.
Chapter III Standard Making
Article 7
The National Competent Authority should make the standard of Skills Certification and can delegate the related institutes and organization to transact if necessary.
The National Competent Authority should congregate and discuss with the related competent authorities for business objectives, schools, training institutes, business institutes or organizations when making the standards.
Article 8
The National Competent Authority shall invite 6~10 persons meeting one of the following requirements to discuss and set the standard of each trade for Skills Certification:
1.Being or having been an assistant professor or higher at college or university and having over five years teaching experience in a related department.
2.Graduating with a related major at university (or higher) and having over ten years teaching experience in a related trade.
3.Graduating from college (or higher), and being or having been the director (or non director status) of a technical department or training department of a related business entity with legal registered documents for over 5 (8 for non director status) years.
4.Graduating from senior high or senior vocational high school (or higher), having the present highest class certificate of a related trade and having over ten years on-site practical experience of a related trade or officiating related vocational training for over ten years.
5.Being a representative of the National Competent Authority or the Competent Authorities for Business Objectives.
The standard of Skills Certification of a trade with special characteristics is not limited by the previous paragraph.
Article 9
The National Competent Authority may request the competent authorities for business objectives, schools, business entities, vocational training institutions and organizations to recommend the previous Article mentioned personnel while selecting.
Chapter IV Composing Exam and Grading
Article 10
Undisclosed exam of the written test and field test of Skills Certification should be composed from the quiz bank by the National Competent Authority.
If the exam of the field test is public, then it would be allotted by the exam instruction
Article 11
The examination agency officiating the written test or the field test adopting the written test (non multiple choice and non true or false) shall officiate the intensive grading. For online testing, the officiating agency shall adopt online grading.
Article 12
The examination agency officiating the written test should read the answering card by high-sensibility and low-sensibility for each one time when adopting the computerized card reader for grading. And decide the grade most beneficial to the examinee.
Article 13
If the answering card not following the requirement can be read when adopting the computerized card reader grading, it should be dealt with in accordance with the following rules:
1. The answering card is counted as 0 if having words or signs against the additional regulation to be unable to read the whole answers.
2. The answering card is counted as how many it reads if being marked with any ineligible pen to be unable to read.
3. The answering card is counted as how many it reads if being corrected unclearly, marked too light or too heavy.
4. It is not counted if the single-choice question having double answers marking.
5. The answering card is counted as how many it reads if the examinee besmears or damages the answering card.
Article 14
If the damaged answering card can't be read when adopting the computerized card reader grading, it should be dealt with in accordance with the following rules:
1. The answering card is counted as 0 if finding that it's made by the examinee after investigation.
2. The answering card is re-counted as how many it re-reads or by hand grading after the Competent Authority asks the examination agency to Xerox and reproduce the answering card if it is damaged during the process or by the card reader after investigation. And the copy should be noted its cause and co-consigned and then sealed and retained with the original answering card by the examination agency.
Article 15
It is divided into initial grading and final grading if it adopts hand grading. Initial grading and final grading are officiated by different personnel. And the grade of the subject is counted as how many by the final grading. If the grades of initial grading and final grading have serious errors, it should be handed in the third person for re-grading and counted as the re-grade.
Article 16
If the answering card not following the requirement when adopting the hand grading, it should be dealt with in accordance with the following rules:
1. The grade of the subject will be deducted 5 if it is answered by ineligible signs or with pencil.
2. It is not counted if the answering marking placement gets wrong or the single-choice question having double answers marking.
3. It is not counted if the answer is corrected unclearly to be unable to identify.
4. The grade of the subject is counted as 0 if the answering sheet has ineligible words, signs or notes.
Chapter V Procedure of Test Administration
Article 17
Skills Certification sign up shall be in accordance with the annual publication. After sign up, it cannot be cancelled, refunded or modified with respect to trade, class, stage or test sight.
In case of natural disasters, important events or other incidents that lead to postponement of the test, the officiating agency shall arrange the test at another selected date. The Competent authority will refund the fee to the applicant unable to attend the test.
Article 18
Skills Certification sign-up and examining of the same trade, same class and same item can't be duplicated.
Duplicate sign-up applicant will be examined at one appointed testing site by the Competent Authority, and the expense of duplicate sign-up won't be refund.
Article 19
Skills Certification consists of a written test and a field test.
A written test adopts the paper and pencil test or online test; other testing methods can be applied if necessary. The score of the written test is graded by percentage with a passing score being 60 or above.
A field test is basically a practical work test. A written test not containing multiple choice or true or false questions can be utilized if it is not possible to adopt practical work. The score of the field test is graded by percentage resulting in a "Pass" or "Fail". The passing score is 60.
If the Competent Authorities for Business Objectives have an alternate passing standard for written and field tests, the standard must be followed.
Article 20
The examination agency of field test should advise the examinees the related information of the field test at least ten days before the test. If there is any regulation for the field test, it must be followed.
Article 21
The answering cards and evaluation sheets of written test and field test of Skills Certification should be sealed and retained after judgment, and should be retained for one year from the date sending the grade report. However, the contentious one posed within the retaining year should be retained for five years.
The sign-up report and identity of the Skills Certification examinee of Class C and Single Class should be retained for one year from accepting the sign-up. However, the contentious one posed within the retaining year should be retained for five years.
The sign-up report and identity of the Skills Certification examinee of Class B and Class A should be retained for five years from accepting the sign-up.
The previous paragraph 1 to paragraph 3 data should be retained by the examination agency of written test or field test. And the data should be listed and recorded for the duration of retaining. The Competent Authority can retrieve and review the data if necessary and request for retaining extension.
Article 22
Personnel participating or officiating the Skills Certification should keep the secret if knowing and possessing the following data, and must not have any behavior of corrupt practices, disclosure or peculation:
1. Quiz of the written test and field test.
2. Evaluation standard and sheets of the field test before the test
3. Reference answers of the written test and field test.
4. Answering cards and sheets of the written test and field test (including workpiece and evaluation sheets).
5. The related data of the testing grade of the disputable subject.
6. Quiz bank preparation, invigilating sites, the invigilator and other related data.
If the materials described in subparagraph 1 to 3 of the previous paragraph, have been opened to the public, are not subject to the limit.
Article 23
If the field test examinee is the related personnel of the examination agency of the field test, the examinee should avoid being examined at the original agency. If there is only one agency officiating the field test, the examination agency of field test should report the Competent Authority for approval in advance to assign another invigilator who is not belong to the agency for invigilating and grading.
Chapter VI Invigilating and Marking of Written Test and Field Test
Article 24
The examination agency of written and field tests shall invite persons meeting one of the following requirements to be the invigilators of the written test and/or the field test consisting of non multiple choice and non true or false questions:
1. Being an appointed rank officer or the personnel equivalent to an appointed rank officer.
2. Being a teacher in a public or private school or faculty.
Invigilators of the written test adopting computer online testing shall pass the training of the National Competent Authority in addition to meeting the qualifications of the previous paragraph.
Article 25
The examination agency of field test should invite the invigilators and markers having received the training of invigilating and marking or being judged qualified by the National Competent Authority for invigilating and marking.
Article 26
The examination agency of the field test, when inviting invigilators and the graders shall be in accordance with the following:
1.If the agency invites no more than 5 persons to be the invigilators and graders at the same site, there may not be more than one person from the same agency.
2.When the agency invites more than 6 persons to be the invigilators and graders at the same site, only 1/3 of the total and may be from the same agency, not exceeding 4 persons.
3.The agency may not invite the same person for more than 2 days if the duration of the invigilation and marking is less than 5 days; for duration over 5 days, the same person may not be invited for 1/2 of the entire duration of the field test.
4.The same personnel may not invigilate and grade the same trade for more than 10 days within the same month.
5.The agency may not invite full time or part time personnel from the examination agency to do the invigilation and marking of field tests for students at the school and trainees of the agency.
Trades with special characteristics are not limited by subparagraphs 3 and 4 of the previous paragraph as approved by the National Competent Authority.
Article 27
If the invigilator or the marker has any of the following circumstances, he should avoid invigilating and marking of the test:
1. The examinee is his spouse, ex-spouse, the consanguineous relative or the affined relative.
2. It is evident that he might have deviation when administrating.
If the invigilator or the marker has the circumstances described in the previous paragraph but still doesn't avoid it, the examination agency of field test and written test should order him to avoid.
Article 28
If the invigilator or the marker is informed by the examinee that the test paper has errors or omissions to be difficult to identify when testing, he should contact the examination agency of field test and written test to investigate instead of correcting by himself.
Article 29
If the invigilator of the written or field test (not containing multiple choice or true or false questions) meets any of the criteria below, the examination agency of field or written tests shall decommission him instantly, notifying the Competent Authority and his/her agency:
1.Being over 15 minutes late or absent from the workshop prior to the invigilation without an acceptable excuse.
2.Unable to effectively maintain order during the test.
3.Losing the test papers, answering sheets (cards) or other documents.
4.Having a poor working attitude while invigilating and/or having quarrels with the examinees.
5.Not following the regulations in Article 27.
1.Being careless as to affect the rights of the examinees and the test.
For invigilator who is decommissioned due to preceding event, the examination agency of written or field tests may discontinue the invitation depending on the gravity of the offense
Article 30
If the invigilator and graders meets any of the following criteria after investigation, he shall be decommissioned instantly and not permitted to invigilate and marking for two years:
1. Being absent from the coordination meeting prior to invigilation and marking without due reason.
2. Unable to maintain order during the test, causing the field test proceed ineffectually.
3. Unfamiliar with examination content or the evaluation standard for the field test. Lacking competency in invigilation and marking.
4. Unable to carry out the invigilation with earnest or with a responsible attitude causing counting and/or recording of test marks to have errors.
5. Creating circumstances which affect the rights of the examinees and the testing.
Article 31
The examination agency of field test should fill in the evaluation reports of executing of the invigilators and markers during each field test.
If the evaluation reports of executing of the invigilators and markers have any record listing against the previous Article matters or the Article 39 of Regulation for Technician Certification and Licensing, the evaluation reports should be reported to the National Competent Authority to be dealt with.
Article 32
If the invigilator or the marker of the written or field test has evidence to avoid or find out the examinee cheating while invigilating or marking, the examination agency of field test or written test should properly award or ask his agency to award him.
Chapter VII Instruction for Examination Sites of the Written Test
Article 33
The examinees of the written test shall have seats according to admission numbers while the preparatory ring is sounding. The examinee may not be admitted more than 15 minutes after the test begins, and may not leave within 45 minutes of the total duration. However the examinees taking the computer based online test will not be limited by the latter regulation.
Article 34
The examinee of the written test shall put admission and identity cards at the upper/left hand side of the desk to be checked after seating; and check the name tag (or answering card), admission number, trade, class and the test paper. The examinee shall inform the invigilators of any inconsistency or missing items.
The examinee of the written test is forbidden to bring a cell phone, pager or any other electronic telecommunication or recording device to the examination site. The stationary except those used for testing shall be put away in accordance with the invigilators' instructions.
Article 35
If the examinee of the written test meets any of the following criteria, he/she must be stopped from testing and forbidden to continue with the examination. The grade will be counted as 0:
1.An impostor.
2.Holding a fake examination identity or spoliation.
3.Changing seats or test papers; exchanging answer cards with other examinees.
4.Circulating data, signs or chatting with other examinees.
5.Carrying related books and documents.
6.Not handing in the test paper or the answer (paper) card.
7.Using the forbidden tools.
8.Looking at other examinees answer cards or allowing others to see his/her answer card deliberately.
9.Writing (copy) relevant words or signs on the desk, stationary, body, admission card or other positions.
10.Not following regulations, not accepting the invigilators' advice, or disturbing the order of the examination site.
Where there is one of forgoing paragraphs occurred to examinee after the time of written test end, the grade of written test will be counted as "Zero".
Article 36
If the examinee of the written test has any of the following circumstances, his grade should be deducted 20:
1.Having the incorrect seat and making other's answering sheet (card).
2.Breaking or damaging the seal of the answering sheet (card), cutting the paper of the answering sheet (card) or besmirching the answering sheet (card).
3.Tearing out the emergent tag and writing the name or other words and signs on the answering sheet (card).
4.Keeping on answering after the time ends or not getting constantly out of the site after handing in the answering card and not following the invigilators' advise
5.Getting out of the examination site within 45 minutes and not following the invigilators' advises.
6.Violate regulations set forth in paragraph 2 of article 34.
Article 37
The examinee of the written test should get out of the site after handing in the answering sheet (card) along with the test paper, and shouldn't get in again afterwards.
Article 38
For the field test adopting practical work, the examinee should get in the examination site on time, and would be forbidden to get in 15 minutes after the test starts; as for the test adopting divided steps or stops, the examinee would not get in if being late except for the first step (stop).
For the field test adopting written test with non-choice quiz, the examinee can follow the regulations of Article 33 to Article 37. However, for written test adopting manual grading process shall follow the regulations of Article 16.
Article 39
The examinee of the field test shall show the admission card, field test notice, identity card, and self prepared tools to the invigilators and graders. All the unregulated devices, illustrations, notes, cell phones, pagers or other electronic telecommunication or recording devices may not be brought into the examination site, when entering the examination site.
The examinee will not be allowed to attend the test if they are not wearing the uniform regulated by the specific trade for the field test.
Article 40
The examinee of the field test should be in the position in accordance with the examining position number, and put the admission, the field test notice and the identity card on the assigned place to be checked.
If the examinee has any dispute toward the machines, tools, equipment and materials supplied by the examination agency of field test, he should pose at that time to ask the invigilators and markers for immediate processing. No dispute is allowed to be posed after the test starts.
Article 41
The examinee of the field test should follow the regulated items on-site narrated by the invigilators and markers.
Article 42
The beginning and ending of the field test shall be decided by the invigilators and markers in accordance with test regulations and the examinee shall not make it advance or delay without permission.
Article 43
The examinee of the field test should take notice of the safety of machines, tools and equipment while operating them.
Article 44
If the machines, tools and equipment in the field test are broken-down due to the examinee's negligence, the examinee should debug on his own without any additional test time.
Article 45
The examinee of the field test should operate the machines, tools and equipment well. The examinee should take fault liability if damaging them deliberately.
Article 46
The examinee of the field test should dispose self-equipped tools and workpiece during the break in accordance with the invigilator and marker's direction.
Article 47
The examinee of the field test should hand in the product, the workpiece or test materials left to the invigilator and marker after the test, including one departs during the process. The examinee can't get in the examination site after handing in the workpiece.
Article 48
If the examinee meets any of the following circumstances, he/she must be stopped from testing and forbidden to continue the examination. The grade for the field test will be counted as "Fail":
1.An imposter.
2.Circulating data or signals.
3.Assisting or commending others on the practical work.
4.Changing the workpiece or figure with another.
5.Bringing a product or unregulated device, fitting, figure, cell phone, pager or any other electronic telecommunication or recording device.
6.Not handing in the workpiece, figure or the test paper according to regulation.
7.Damaging the machines, tools and facilities deliberately.
8.Not compliance with the Regulations or accepting the instruction of the invigilators and graders and disrupting order within or outside of the examination sight.
9.Not compliance with the regulations of Article 23.
10.Knowing invigilators and graders are not following regulations of Article 27 to refuse involvement and continuing the examination.
Where there is one of forgoing paragraphs occurred to examinee after the time of field test end, the grade for the field test will be counted as "Fail".
Chapter VIII Handling of Disputes of Test and Grades Reviewing
Article 49
If the examinee has any disputes toward the written test and the field test adopting written test with non-choice quiz, he should pose it to the Competent Authority or the written and field test examination agency with a written form listing the following items within 7 days after the test:
1. Name, admission number, address and contact phone number.
2. Trade of the test, class, date and number of the quiz.
3. If the quiz or answers have improper items or errors, it should be narrated and explained and reported to along with the related data.
The due date of posing disputes by the examinee is according to the postmark, and the disputes wouldn't be dealt with over the due date.
The examinee should pose the dispute once for one quiz
Article 50
The Competent Authority or the written and field test examination agency should handle the above disputes in accordance with the following process:
1. If the dispute concerns the essential content of the test, the Competent Authority should report the dispute data, the quiz and the answer to the personnel of quiz bank proposition to declare their viewpoint within 7 days. If necessary, the Competent Authority could invite other experts to discuss and deal with the viewpoints, and then review the test paper to inform the examinees.
2. If the dispute doesn't concern the essential content of the test, it could be handled by the Competent Authority or the written and field test examination agency directly.
The personnel of quiz bank preparation mentioned in the first subparagraph of the previous paragraph could invite other personnel of quiz bank preparation to take the alternative to deal with.
Article 51
If the quiz or answers have any error or defect after investigation, it would be dealt with according to the following regulations:
1. If the quiz has an error to result in none correct answer, then the grade of the quiz will be added for all examinee.
2. If the quiz has a defect, but still has a correct answer or the announcing answer is wrong, then the test will be reviewed according to the revised answer.
Article 52
If the field test adopting the written test with non-choice quiz has any error or defect after investigation, it would be dealt with according to the following regulations:
1. If the quiz or its sub-quiz has an error unable to be answered, then the grade of the quiz or its sub-quiz won't be counted. And the grade should be adjusted and dispensed to other quiz of the subject or its sub-quiz.
2. If the quiz has a defect but still can be answer, then the test will be reviewed according to the revised answer.
Article 53
If the examinee has any dispute toward the quiz and test environment of the field test adopting the practical work during the process of testing, he should pose it promptly and the invigilators or the markers should record it. The dispute not posing and being recorded promptly won't be accepted.
The previous paragraph mentioned dispute would be dealt with according to the regulation of Article 50.
Article 54
If the examinee has any dispute toward the grade of the written or field test, he can ask for grade reviewing by the Competent Authority or the written and field test examination agency once within 15 days after receiving the transcript. It won't be accepted if it's over the due date.
Article 55
The Competent Authority should deal with grade reviewing of the examinee according to the following methods:
1. For the written test, the Competent Authority should check the correspondence of the applicant's answering card and his admission number, and then check the method of answering if in accordance with the regulation, and check the counting and recording if having no mistake.
2. For the field test, the Competent Authority should check the correspondence of the applicant's answering sheet or his evaluation listing and his admission number, and then check the grade applied for reviewing to confirm the counting of each item and recording having no mistake.
The Competent Authority should reply and send the reviewing result by the above process and the evaluation method of each trade to the applicant. The original sheet (card) can't be sent to the applicant. And the Competent Authority should inform the applicant the cause if the answering method or the tools used by the applicant is not regulated, and the grade can't be counted correctly.
Article 56
The applicant for grade reviewing is not allowed to ask for reviewing and grading, browsing, having the copy the answering sheet (card) and the evaluation sheet and offering the grade of each item or the reference answers of the field test. It is also not allowed to be acknowledged the name or other related information about the personnel for quiz bank proposition, invigilating and grading.
Chapter IX Handling of Accidental Matters
Article 57
If there is any of the following circumstances, the principal or invigilators or the markers of the examination agency should supplement the testing duration with the delay time:
1.Delaying the answering time of the examinees due to the negligence of the test working.
2.Delaying the examinees arriving at the examination site on time due to the arrangement of the examination site or other matters.
3.Moving to another proper site to have the test after the decision due to improper arrangement of the examination site or the equipment.
4.Abandoning the test after the decision due to accident occurred during the process.
Article 58
The grade should be added by the proportion of advancing time in the whole duration if ending the testing time without following the regulation to return the test papers.
Article 59
The written or the field can't be proceed while having power cut, typhoon, earthquake, air raid, flood, fire, omission of the test papers, missing the test papers or any other serious accident. It should be dealt with in accordance with the following regulations:
1. For happening before the test, the examination of the written or the field test should report to the Competent Authority to decide. If the test will be held on another date, it should be proclaimed by the agency and notice the examinees.
2. For happening during the test process, after consideration the principal of the examination agency should advise the invigilator or the marker to return all the answering sheets (cards) or the workpieces promptly. If the duration of the written test or the field test adopting the written test with non-choice and non truth-or-false quiz is not over 1/2 of the whole time, the test must be held on another date. As for the test which is over 1/2 of the whole time, the grades of the examinees should be counted according to the previous paragraph rule.
3. If the situation described in the previous subparagraph happening to the field test adopting the practical work, the field test officiating agency should deal with it.
Article 60
If the written test can't be held and must have to be held on another date due to the previous Article circumstances, the proposition of the test should be renewed. However, if the Competent Authority makes sure that there is no possibility of indiscretion, it can adopt the original test.
Article 61
If the examinee's answering sheet (card) is cut or damaged due to the negligence of the personnel of testing affairs, it should be listed on the examination record.
Article 62
If the examinee's completed answering sheet (card) is missed or damaged after testing but before recording and the grade can't be counted, the examination agency should report the viewpoint of handling to the Competent Authority to review and decide.
Chapter X Supplementary Provision
Article 63
The patterns of documents, forms and tables in this regulation are to be prescribed by the National Competent Authority.
Article 64
This regulation is implemented since the day it is proclaimed
