Chapter I General Principles
Article 1
This regulation is drafted in accordance with the paragraph 2 , of Article 33 of the Vocational Training Act.
Article 2
The job entries of the National Competent Authority are listed as follows:
1. Drafting, amending, and explaining the laws and regulations of Skills Certification.
2. Establishing the quiz bank of the written test and field test of Skills Certification.
3. Ratifying the charging standards of the written test and field test of Skills Certification; regulating the expenses.
4. Qualification ratifying, training, and certificate issuing in terms of Skills Certification invigilating and marking personnel.
5. Assessing the fields, machines and other relevant facilities for holding the field test, and issuing the certificates.
6. Drawing up and proclaiming the plan for the National Skills Certification.
7. Managing the specific project implementation and consigning the implementation in terms of Skills Certification.
8. Ratifying and controlling the Technician Certificates and Diplomas.
9. Making the negotiation and promotion in terms of the effectiveness of Technician Certificates.
10. Rewarding the well-performed Skills Certification holding agencies and personnel.
11. Promoting, implementing, monitoring, negotiating, and examining other Skills Certification affairs.
Article 3
The job entries of the Municipal Competent Authority’ are listed as follows:
1. Executing the National Skills Certification plan made by National Competent Authority.
2. Managing Skills Certification sign-up, qualification checking, and charging matters.
3. Composing, sorting, computing, and analyzing all the data provided by the Skills Certification candidates.
4. Planning, executing and monitoring the written test regarding Skills Certification.
5. Planning, executing and monitoring the field test regarding Skills Certification.
6. Compiling the roster of the qualified candidates for the Skills Certification.
7. Assisting the management of the Technician Certificates and diplomas.
8. Other cooperative matters regarding promotion of Skills Certification.
Article 4
The County Government should assist the National Competent Authority to manage the Technician Certificates and Diplomas.
Chapter II Qualification Criteria for Applying for Certification
Article 5
Skills Certification trades could be classified as Class A, B and C. As for trades couldn’t be classified belong to Single Class.
Article 6
One above 15 years of age or with a junior high school diploma can participate in the Class C or Single Class Certified Technician Skills Certification.
The aforementioned age shall refer to the first day of the written test at the same session held by the certification agencies.
Article 7
One meeting any of the following qualifications can participate in the Class B Certified Technician Skills Certification:
1. One having obtained a Class C Technician Certificate and received related vocational training for over 800 hours, or having over 2-year experience in related work.
2. One possessing a Class C Technician Certificate, as well as having a senior high school diploma or equivalent documents, or currently at the highest grade in senior high school.
3. A student having obtained a Class C Technician Certificate, and is currently at the third grade or higher in a 5-year junior college; a 2-year or 3-year junior college student; a student in an institute of technology or university, or with equivalent documents.
4. One having received 400 hours of related vocational training as well as over 3-year experience in related work.
5. One having received 800 hours of related vocational training as well as over 2-year experience in related work.
6. One having received over 1,600 hours of related vocational training.
7. One having received over 800 hours of related vocational training, and possessing a senior high school diploma or equivalent documents.
8. One having received 400 hours of related vocational training as well as over 1-year experience in related work, and possessing a senior high school diploma or equivalent documents.
9. One having received 2 years of apprentice training as well as over 2-year experience in related work.
10.One having a senior high school diploma or equivalent documents, as well as over 2-year experience in related work.
11.One with a related major of junior college diploma from institute of technology or a higher degree from university, or currently being at the highest grade in school.
12.One with an unrelated major of junior college diploma from institute of technology or a higher degree from university, and having received over 400 hours of related vocational training, or having over 1-year experience in related work.
13.One with over 6-year experience in related work.
The previous paragraph “vocational training” and “apprentice training” are verified by the
National Competent Authority, and must be subject to the trainees of licensed vocational
training institutes or the training institutes commissioned by the government.
Article 8
One meeting any of the following qualifications can take the Class A Certified Technician Skills Certification:
1. One having obtained a Class B Technician Certificate and had over 2-year experience in related work.
2. One having obtained a Class B Technician Certificate and received related vocational training for over 800 hours.
3. One having obtained a Class B Technician Certificate as well as a diploma of institute of technology, university, or equivalent documents, and had over 1-year experience in related work.
4. One having obtained a Class B Technician Certificate as well as a diploma of institute of technology, university, or equivalent documents, and had over 1-year experience in related work.
5. One having a related major of junior college diploma or equivalent documents as well as over 4-year experience in related work; or one having a unrelated major of junior college diploma or equivalent documents as well as over 6-year experience in related work.
6. One having a diploma or equivalent documents obtained after graduating from institute of technology or university with related major as well as over 3-year experience in related work; or one having a diploma or equivalent documents of unrelated major as well as over 5-year experience in related work.
The previous paragraph trade-related vocational training is verified by the National Competent Authority, and must be subject to the trainees of licensed vocational training institutes or the training institutes commissioned by the government.
Article 9
If the National Competent Authorities for Business Objectives have additionally made another regulation, then the regulation must be prior to the above three Articles of qualification criteria for applying for certification. As for some special Skills Certification trades, the qualification criteria should be additionally drafted by the National Competent Authority and consulted with the National Competent Authorities for Business Objectives
Article 10
One is regarded as “Pass” when having passed both the written test and the field test under the same trade and class.
One’s test result can be retained for 3 years from the coming year if one has passed either the written test or the field test.
The paragraph 2 “Retained Years” does not include the year of test suspension.
Article 11
One meeting any of the following qualifications is exempt from the field test:
1. The top three winners or diploma awards winners of the World Skills Competition held by the World Skills International and the International Abilympic Federation for the Disabled attend Skills Certification of the same trade within 5 years from their winning day.
2. One having passed the National Skills Competition and National Skills Competition for the Disabled held by the National Competent Authority attends Class B or Class C Skills Certification of the same trade within 3 years from the day of qualification.
3. The top three winners of district preliminary Skills Competition held by the National Competent Authority and those of skills contest held by approved institutes, schools, or corporations attend Class C Skills Certification of the same trade within 3 years from their winning day.
The aforementioned trades and time limit exempted from the field test can deduct the time reduced from a suspension of certification or a termination of certification.
The previous paragraphs regarding trades and time limit exempted from the field test are proclaimed by the National Competent Authority.
The qualification criteria and necessary documents for applying for a qualified agency mentioned in subparagraph 3, paragraph 1 of this Article are proclaimed by the National Competent Authority.
Chapter III Commission managing the written test and field test
Article 12
The National Competent Authority should proclaim an executing plan for annual national Skills Certification including its holding dates, trades of each class, sign-up, tests and other related matters before the year starts and holds a National Skills Certification for non-specific persons.
The National Competent Authority can hold Skills Certification for designated examinees and purposes if necessary.
The Competent Authority can authorize its lower-leveled offices/departments or commission other organizations/institutes, schools, or cooperation to hold the written test and the field test of Skills Certification and to handle the related affairs.
Article 13
The site and machines, tools and equipment of any examination agency on commission adopting the practical work for the field of Skills Certification should be qualified by the National Competent Authority.
Article 14
The commission of the Skills Certification agency is terminated by Competent Authority under the following circumstances:
1. It is evident that having deliberate or dishonest reviewing of the qualification of the examinees of Skills Certification after investigation.
2. Not following the related regulations of the examination affairs and having no improvement in the limited after being advised.
3. It is evident that charging the additional or improper expense for vocational training and Skills Certification after investigation.
4. Authorizing the commissioned affairs to the other agency without admission.
5. Violating this regulation and other related rules and having serious matters.
Article 15
The National Competent Authority can authorize the following agency to hold the written test or the field test of Skills Certification for designated examinees:
1. Public vocational training institutions holding Skills Certification for designated examinees of trainees.
2. The vocational training entities of the correctional instituion subordinated to Ministry of Judicial Administration or the Ministry of National Defense holding Skills Certification for inmates.
3. Business entities holding Skills Certification for on-job employees.
4. The agencies (institutions) subordinate to the Ministry of National Defense holding Skills Certification for designated examinees of military staff.
5. Ministry of Education holding Skills Certification for students.
6. Constitutional trade associations holding Skills Certification for designated examinees of employee hired by the manufacturers.
7. Constitutional craft union holding Skills Certification for designated examinees of members.
8. Other agencies approved by the special projects holding Skills Certification for designated examinees.
Article 16
Any agency on commission holding Skills Certification for designated examinees should conform to the following qualification:
1. Public vocational training institutions and the vocational training entities belonging to the Ministry of Judicial Administration or the Ministry of National Defense or subsidiary to the Control Yuan of R.O.C.: The held trade should be related to the training program, and the present training term should conform to the following rules:
(1) Class A and B certification: Having finished the rudimentary training proclaimed or approved by the vocational training Competent Authority.
(2) Class C certification: Over 80 hours.
2. Business entities:
(1) Having the legal registration identity with business related to the trade of Skills Certification.
(2) Having the constitution of employment of the personnel with the Technician Certificate for specific job, and the regulation of promotion, wage hiking and other encouragement to reward the personnel with the Technician Certificate.
(3) Holding the short-term skill training approved by the Competent Authority for on-job employees and pay or subsidize the fee for them.
3. The agencies (institutions) belonging to the Ministry of National Defense: Holding the short-term skill training approved by the Ministry of National Defense for the military staff.
4. The National Education Competent Authority: Its holding procedure, the officiating units and any other related affairs should be regulated by annual implementation plan discussed by the National Competent Authority and the National Education Competent Authority.
5. Constitutional trade associations or craft union:
(1) Having the charters with mission related to the trade of Skills Certification.
(2) Having possessed the accreditation certificate approved by the Competent Authority for over 3 years.
(3) Possessing the written proof declared by the Competent Authority to confirm the normal operation.
(4) Devising the operation plan for Skills Certification that having the record of being addressed, admitted and list, and having reported to be approved by the Competent Authority.
(5) Equipping with the site of the written test for over 10 people at one time.
(6) Holding the short-term training for the employees hired by the manufacturers (belong to the members) or the members, and having reported to be approved by the Competent Authority.
Article 17
Personnel applying for Skills Certification for designated examinees should conform to the following qualifications including those listed in Chapter II:
1. Trainee: Being the present member of the vocational training institution, and having the related training program to the applying trade.
2. Inmate: Being the present member of the vocational training hold by subordinate vocational training unit under correctional institution of Ministry of Judicial Administration or the Ministry of National Defense, and having the related training program to the applying trade.
3. On-job employee: Having the training certificate of short-term skill training and being the present employee having been covered in government employee’s insurance or labor insurance.
4. Military staff: The military officer, the student of military college or the staff selected by the military unit having the training certificate of short-term skill training.
5. Enrolling student: Being the present student with the recognized status.
6. Vocational teacher: The teacher in the public or private school and having the training certificate of short-term skill training or the personnel of skills training of the national military or association subordinate unit cooperating with the education Competent Authority.
7. Employee hired by the manufacturer subordinary to the association: Having the training certificate of short-term skill training and having participated in labor insurance.
8. Member of the labor union: Having the training certificate of short-term skill training and having been covered in labor insurance.
The previous paragraph personnel applying for Skills Certification for designated examinees should apply for only one trade at one time.
Article 18
Trades and classes for Skills Certification for Designated Examinees shall be limited to those proclaimed for national Skills Certification and trades with the field test which are not confidential.
Article 19
The agency of Skills Certification for designated examinees should conform to the following items except getting the admission from the National Competent Authority:
1. The number of the examinees for the same trade of the same class for the same date must be over 10.
2. The written test of Class A and B should be held coordinating with the national Skills Certification. But the National Competent Authority should arbitrate the class, the quiz of subjects and testing date for each trade.
Chapter IV Assessment and Grant of Field Machines, Tools and Facility for Field-Test
Article 20
If the agency holds the field test of the Skills Certification adopting the practical work, its site, machines, tools and equipment should be evaluated by the National Competent Authority. And if the site of the field test is on the sea, under the sea or on the air, it is not needed to be evaluated.
Article 21
Unless approved by the National Competent Authority, the agency applying for field test sites for Skills Certification and machines, tools and equipment for evaluation shall conform to one of the following qualifications:
1. Vocational training institutes: Which are registered or approved by Regulations for the Establishment and Administration of Vocational Training Institutes, have the Certificate of Vocational Training Institute Establishment, and have training courses related to the trades for evaluation.
2. Schools: Which are the public or private senior high school (or higher) approved by the educational Competent Authority, and have departments related to the trades for evaluation.
3. Business entities: Trade related companies which are registered by the Company Act or the Business Registration Act, have certified documents of company registration or business registration and businesses related to the trades for evaluation, and have registered capital amount exceeding NT$15,000,000 thirty million and employees exceeding 100.
4. Organizations: Trade related associations, labor unions or national corporate bodies with registration certificate which are established over three years and apply trades for evaluation related to the businesses of their members.
5. Governmental agencies (institutes) or government supported incorporated organizations: Agencies (institutes) or government supported incorporated organizations set in accordance with government organizational regulations.
Article 22
The National Competent Authority shall declare the annual proclamation of field test sites for Skills Certification, machines, tools and equipment for evaluation and other related matters by the end of January each year, and declare an additional proclamation if there are any other special circumstances.
The items in the afore-mentioned proclamation are as following:
1. The trade, class and field test sites for Skills Certification and self reporting of machines, tools and equipment evaluation (hereinafter referred to as “self report”), the examination site and expected quantity.
2. Proclaimed date of application for the field test sites as well as the results, application and evaluation duration of machines, tools and equipment evaluation.
Article 23
The agency applying for the field test sites for Skills Certification and the machines, tools and equipment evaluation should conform to the regulations in accordance with the self-report of each trade after self evaluation and attach the following documents and self-report two sets with one form for reviewing to the National Competent Authority to ask for evaluation:
1. Copy of the establishment identity. Governmental agencies and public schools are not under this limit.
2. Copy of domain of the examination site or the apograph of agrarian registration, copy of architecture ownership or the apograph of architecture registration. Governmental agencies and schools are not under this limit.
3. Schools should attach syllabus related to the applied trades for reviewing.
4. Organizations should attach the identified documents of affairs proceeding by the Competent Authority.
For the subparagraph 2 of previous paragraph, if the examination site is rental, the agency should attach the agreement of rental or usage with term at least 2 years from acceptance of applying. However, those agencies with special conditions and exclusively approved by National Competent Authority are not excluded.
The same site and the machines, tools and equipment can’t be supplied to over two agencies for evaluation.
Article 24
The evaluation process of the field test sites for Skills Certification and the machines, tools and equipment evaluation are as following:
1. Initial reviewing: It will be done with the written form by the National Competent Authority.
2. On-site evaluation: After the field test sites, the machines, tools and equipment pass the initial reviewing, the National Competent Authority will invite personnel of the quiz bank preparation or 2 to 3 persons qualified as the invigilating and marking national to do the on-site evaluation. The result of evaluation should be filled in the table of the evaluation report.
Article 25
Agency being qualified after on-site evaluation should be issued with the certificate of qualified sites and the machines, tools and equipment evaluation, and the certificate should list the following items:
1. Title of the qualified certificate.
2. Trade and the class.
3. Quantity of the examination site.
4. Address of the site.
5. Valid date.
If there is any amendment concerning the first to the fourth subparagraph of previous paragraph or the machines and tools, the agency should report to the National Competent Authority.
For the valid date mentioned in the fifth subparagraph, paragraph 1 of this Article, it is 5 years from the issuing date. If the site rental duration is under 5 years, the valid date is the same as the expiration date of the site lease contract and use agreement. However, while occurring the incident as description in Article 27, the regulation must be followed.
Qualified agencies should refill the self-report for the National Competent Authority to examine within three month before the valid date. If necessary, the National Competent Authority can do the on-site evaluation anytime.
Article 26
The National Competent Authority should subsidize the agencies for the field test of Skills Certification with the needed machines, tools and equipment according to the lists of estimated expenditures.
Article 27
The National Competent Authority shall proclaim a newly revised self report three months prior the application year if there is a crucial amendment to the quiz for trades for Skills Certification.
Qualified agencies shall do a self evaluation according to the above self report and apply for the evaluation or submit the status of adjustment within the allocated time proclaimed by the National Competent Authority.
Article 28
Agencies with special characters or being the outlying islands can be not limited by the quantity of the participant for each time after getting the approval of the National Competent Authority.
The qualified certificate of the approved agency for its special characters should be additionally noted its limit for Skills Certification for designated examinees.
Article 29
The National Competent Authority shall abolish a qualified certificate of an agency and notify the agency of the withdrawal of the certificate in any of the following circumstances:
1. The site and the machines, tools and equipment having been seriously damaged or changed for other purposes that a field test is not possible.
2. The site does not conform to relevant regulations after inspection by departments of the building administration, environmental protection, fire, and health and safety showing no improvement within the time limit by each Competent Authority for business objectives.
3. Failing to carry out improvements requested by the Competent Authority after site, machines, tools and/or equipment after evaluation are found to be substandard.
4. Refusing to accept the commission of the Authority for field tests without any due reason.
5. Not following the second paragraph of Article 27.
6. Violating the third paragraph of Article 23.
7. Committing any corrupt practice while holding a Skills Certification.
8. Other violations of this regulation or other serious matter violating related regulations.
Qualified agencies shall report to the National Competent Authority to terminate Skills Certification in a situation under the first and second subparagraphs of the previous paragraph. The qualified certificates will be abolished and the evaluation application will not be accepted if found unreported.
Article 30
National Competent Authority may abolish the qualified certificate if qualified unit provide the information or documents applying for evaluation with counterfeited, forged or other false contents.
Chapter V Qualification Reviewing, Training and Evaluation Regarding the Personnel of Invigilators and Markers
Article 31
The National Competent Authority shall proclaim to hold the qualification training of
invigilators and markers in any of the following cases:
1. A newly developed trade.
2. A trade with inadequate qualified invigilators and markers after evaluation.
3. Any other trade requiring certification.
Article 32
The following agencies, institutes or associations shall assign personnel to participate in
the qualification training of invigilators and markers after receiving the appointment from
the National Competent Authority:
1. Agencies for managing the field test.
2. Agencies of standard drafting, personnel service for quiz bank proposition of the written and field tests.
3. Qualified agencies of training for the field test sites for Skills Certification and machines, tools and equipment evaluation.
4. Vocational training institutes or schools equipped with the same or the related departments to the trades of vocational training.
5. Business entities equipped with the same technique or equipment as the trade of vocational training.
6. Craft unions, trade associations and professional organizations related to vocational training.
7. Each Competent Authority for business objectives.
8. Other organizations designated by the National Competent Authority.
Article 33
One meeting any of the following qualifications can be designated by the agencies,
institutes or associations mentioned in the previous Article or self-recommended to join
the qualification training for invigilators and markers.
1. One graduating from junior college (or higher), and being or having been a technician in a business entity related to the trade of vocational training with legal registered certificate, a teacher of senior (vocational) high school (or higher), a military instructor of military academy, a technician, or a trainer of vocational training institutes, and having over 8 years working experience related to the trade of vocational training.
2. One with a related major holding a junior college diploma (or higher degree) and being or having been the director, engineer or related status in a business entity, the director (section chief) or higher status of a vocational institute, or lecturer, director or higher status in an education entity, and having over 3 years working experience related to the trade of vocational training.
3. Having been invited to be training personnel of trade Skills Certification standard drafting and the preparation of the written or field test quiz bank by the National Competent Authority.
4. Being an expert or administrator (director) with a scholarship and experience, recommended by each Competent Authority for business objectives or the National Competent Authority.
5. One having over 13-year experience in related work after graduating from senior (vocational) high school (or higher), and possessing the technician certificate of a trade not having Class B Skills Certification before.
The National Competent Authority shall carry out the selection of personnel designated by agencies, institutes or associations mentioned in the first paragraph or self recommended personnel in public.
Personnel conforming to the previous paragraph qualifications with graduation in a related major, lecturing the related program and possessing a certificate of technical training will be selected by priority.
One may not participate in the training while being an administrator or teacher of the related trade for Skills Certification at a cram school for profit.
The qualifications for the trades with specific circumstances shall be approved by the National Competent Authority.
Article 34
Personnel participating in the qualification training of the invigilators and markers should complete the whole training program; after passing the test to obtain the qualification, the personnel will receive the certificate of invigilators and markers issued by the National Competent Authority.
The validity period of the certificate of invigilators and markers is five years from the issuing day of the certificate.
Article 35
The National Competent Authority should hold a reviewing meeting for the qualified personnel of invigilating and marking if having the following circumstances:
1.Extra new trades.
2.The trade with crucial amendment of the field test of Skills Certification or standard of invigilating and marking.
3.The trade that fail to hold reviewing meeting within five years.
4.Any other trade necessary to be held.
Article 36
Participants of the reviewing meeting mentioned in the previous Article shall participate in the entire program and pass the relevant test to be entitled to take on invigilation and marking.
Personnel failing to participate in the aforementioned reviewing meeting for invigilators and markers, complete the whole meeting, or pass the test will be suspended to practice invigilation and marking.
Article 36-1
The invigilators and markers who sign in for participation in Skills Certification of the same trade cannot be employed for the work of invigilation and marking in said field at said time.
Article 37
The invigilators and markers should keep the confidential if being aware of the grades of the filed test due to the duty and business.
Article 38
The invigilators and markers can’t refuse to invigilate and mark in the designated site of the field test.
Article 39
The National Competent Authority shall abolish or disqualify the certificate of invigilators
and markers and inform the personnel qualified as invigilators and markers to return the
certificate if any of the following circumstances are investigated to be true:
1. Being an administrator or teacher of a related trade for Skills Certification at a profit-seeking cram school during the valid period of the certificate.
2. .Participating when an examinee is a spouse, ex-spouse, or other close relative or in some way causes deviation from duty with evidence.
3. Losing all or some of the test papers, answer sheets (cards), work piece or evaluation report or other documents.
4. Disclosing or peculating the confidential quiz, standard of evaluation, evaluation forms, reference answers, grades or confidential data comprehended or possessed from duty and business.
5. Disclosing or peculating the confidential quiz, standard of evaluation, evaluation forms, reference answers, grades or confidential data comprehended or possessed from duty and business.
6.Providing qualification certificates with counterfeited, forged or other false contents.
7. Violating regulations set forth in Paragraph 1 of Article 36 or in Article 38.
8.Violate regulations set forth in paragraph 1 of article 36 hereo
9.Confirmed sentence of imprisonment for over 1 year without suspension, except offense of negligence.
10. Any other negligence affecting the examinee’s rights and fairness of the tests.
If the personnel qualified as invigilators and markers happen to have the circumstance as the subparagraph 1 of the previous paragraph within the duration of suspension, the personnel’s certificate of invigilators and markers will not be abolished or disqualified.
After the certificate of invigilators and markers is abolished or disqualified, the personnel shall not attend the qualification training held for invigilators and markers
Chapter VI Quiz Bank Settling and Administration
Article 40
The National Competent Authority should set the quiz bank and assign the administrators take charge of the management to unify the administration of Skills Certification quiz.
The administrators of previous paragraph should keep the confidential.
Article 41
The qualification criteria of employment of quiz bank preparation personnel of each trade shall be in accordance with the following items:
1. Being or having been an assistant professor (or higher) of college or university, and having over 5 years working experience related to the trade of vocational training.
2. Graduating from university (or higher) with a related major, and having over 10 years working experience related to the trade of vocational training.
3. Graduating from college (or higher), and being or having been the director (or non-
director) of a technical department or training department of related institutes with legal registered documents for over 5 (8 for non director status) years.
4. Graduating from senior (vocational) high school (or higher), and having the highest qualification certificate of a related trade and having over 10 years practical experience or engaging in related vocational training for over 10 years.
5. Representatives recommended by the competent authority at all levels or by the competent authority for business objectives.
Quiz bank preparation personnel for a trade with special requirements may not be selected
according to the previous paragraph and are not under the previous limitations.
The number of personnel for preparation for the quiz bank of each trade shall be 6-10 in principle. Each one shall only prepare for the quiz bank of one trade.
Article 42
The National Competent Authority may request the related competent authorities for business objectives, schools, vocational training institutions and organizations to recommend the personnel mentioned in the previous Article for selection.
Article 43
Personnel of quiz bank preparation possessing or being aware of the covert quiz and other related data during the process of preparation. Personnel of quiz bank preparation should keep the confidential and not disclose or publish books and handout.
Article 44
One having any of the following circumstances can’t be selected as the personnel of quiz bank preparation; one should be dismissed if having been selected:
1. Investing and operating the cram school such profit-seeking units related to the trade.
2. Being the administrator or teacher of the cram school or any other for-profit unit related to the trade.
3. Being against the previous Article.
Article 45
Personnel of quiz bank preparation shall not enroll for Skills Certification of the same trade during the preparation of the quiz bank and the usage of the quiz. However, this limitation does not apply to the usage of quiz exceeding 2 years.
During the period of participating preparation of the quiz bank and the usage of the quiz, the quiz bank preparation personnel shall refuse involvement when an examinee is a spouse, ex-spouse, or other close relative.
For violation of preceding two paragraphs, the regulations set forth in previous article shall apply.
Article 46
The quiz of the confidential written and field test should be sealed by the quiz bank administrators and should be handed in to the test-paper receiver to sign up, or reported to the head of the examination agency in person.
The related personnel of the examination agency should keep the confidence during the process of retrieval, printing and distribution of the confidential quiz.
Chapter VII Technician Certificate Issuing and Managing
Article 47
The National Competent Authority should issue Technician Certificates to those who have passed the Skills Certification, and further give the diplomas if required by the above mentioned persons. One can apply for change or reissue if one’s Technician Certificate or Diploma is damaged or lost.
The National Competent Authority can authorize and ask the commission other organization/institutes or cooperation to issue Technician Certificates and Diplomas.
Article 48
The content of a Technician Certificates and a Diplomas shall contain the following items:
1.Name, date of birth, and I.D. number
2.Photo
3.Trade name and trade level
4.Technician Certificate serial number.
5. Certificate-Issuing department
6. Valid date
7. Issuing date
Article 49
Any Technician Certificate and Diploma can’t be lent or rented to others. Violating the above regulation, the National Competent Authority should nullify the Technician Certificate, and nullify the Technician Diploma.
If the examinee’s qualification does not conform to the regulations for Skills Certification, or it’s evident that the examinee cheating or violating the regulations of the written or the field test after investigation, the qualification and the grade of the written or field test should be nullified and the certificate can’t be issued. As for the Technician Certificate and Diploma having been issued, both should be nullified afterwards.
Examinees or participant involved in cheating mentioned in the previous paragraph will be reported to the related schools or institutes by the competent authority as subjects to accusation according to the regulations. The competent authority shall send those involved in criminal liabilities to the institution of prosecution.
The National Competent Authority should inform the related Competent Authorities for Business Objectives while nullifying a technician qualification or a diploma.
Article 50
While receiving applications for taking the written test or the field test of Skills Certification, reviewing grade, and issuing Technician Certificates, the Competent Authority should collect the (test) sign-up expense, the reviewing expense, postage and the certificate & license expense.
Chapter VIII Supplementary Provisions
Article 51
The Competent Authority should reward individuals, business organizations, schools, vocational training and employment service institutes having excellence of promoting Skills Certification.
Article 54
The patterns of documents, forms and tables in this regulation are to be prescribed by the National Competent Authority.
Article 55
This regulation is implemented since the day it is proclaimed.
