Article 1
These Regulations are enacted pursuant to Paragraph 2, Article 15 of the Protective Act for Mass Redundancy of Employees (hereinafter referred to as the "Act").
Article 2
In order to keep abreast of the changing trends of the labor market, the Council of Labor Affairs, Executive Yuan (hereinafter referred to as the "CLA") shall form a labor market trend-changing assessment committee (hereinafter referred to as the "Committee") consisting of eleven (11) members, including one Chairman served by the Vice Chairman of the CLA, and other members appointed or retained by the CLA as follows:
1. One representative of the CLA.
2. One representative of the Council for Economic Planning and Development of the Executive Yuan.
3. One representative of the Directorate General of Budget, Accounting and Statistics of the Executive Yuan.
4. One representative of the Ministry of Finance.
5. One representative of the Ministry of Economic Affairs.
6. Five expert/scholar members.
Article 3
The tenure of the members of the Committee shall be two (2) years, which may be renewed upon expiry of the tenure.
Article 4
The missions of the Committee are as follows:
1. To collect information related to business entities that have initiated mass redundancy plans.
2. To analyze the causes of the mass redundancy implemented by business entities.
3. To provide recommendations pertaining to industrial and employment policies.
Article 5
The CLA may provide to the Committee for its assessment and analysis the relevant information obtained from the early warning notices prescribed in Article 11 of the Act.
In order to perform the assessment and analysis prescribed in the preceding Paragraph, the Committee may dispatch its member(s) to visit the business entity with appropriate competent authorities. The dispatched member(s) shall submit visiting reports to the Committee for discussion. Such reports shall be provided to the CLA or other administrative authorities for reference in developing relevant industrial or employment policy.
Article 6
Meetings of the Committee shall be convened by the Chairman once every three months; and special meetings may be held when necessary.
The Committee may, if necessary, invite representatives from the CLA or the local competent authorities to attend the meeting(s) and provide explanations.
Article 7
A meeting of the Committee may proceed only when the majority of the members are present; and resolutions may be adopted only by a majority vote of the members present.
Article 8
The Committee shall have an executive secretary appointed by the CLA; and the operating personnel as required by the Committee shall be appointed from among the staff of the CLA.
Article 9
With regard to the relevant information or special research reports known to the members of the Committee in their performance of duties, the members shall keep them in confidence and not disclose them prior to CLA's publication.
Article 10
Members of the Committee shall have no remuneration, while the expert/scholar members may receive an attendance allowance in accordance with the applicable regulations.
Members who are dispatched to visit relevant business entities may receive travel allowances.
Article 11
The costs required by the Committee shall be budgeted and financed by the CLA.
Article 12
These Regulations shall come into force from the date of promulgation.
