1. 1999.03.10 Measures of Allowance for the Vocational Training for the Handicapped
Article 1
These measures are promulgated according to Item 3 of Article 29
in the Handicapped Protection Law.
Article 2
The competent authorities referred to in this measure are the
labor administration competent authorities of all levels.
Article 3
The items and methods applicable for the training expense
allowance are the following:
1. Items applicable for the expense allowance:
(1) Labor Insurance fees of the trainees;
(2) Case processing expenses of the trainees;
(3) Housing or transportation allowances of the trainees;
(4) Occupation ability evaluation and occupation type assessment fees of the
trainees;
(5) Employment assistance and follow-up counseling fees of the trainees;
(6) Meal allowances of the trainees;
(7) Hourly fees of the trainers;
(8) Miscellaneous training expenses;
(9) Material expenses;
(10) Administration expenses.
2. Methods applicable for the expense allowances:
(1) The calculation of the hourly fees of the trainers and the
administration expenses is computed with one class as being a single
computational unit; those classes with fewer than the basic number of trainees
(fifteen persons) will be calculatedwith the individual as a unit; all other
allowances are calculated with individuals as single units.
(2) With the exception of the labor insurance allowance provisions of the
trainees payable, which are stipulated according to the Bureau of Labor
Insurance, all other provistions are prescribed by the central labor
administration authorities.
Article 4
The items and methods applicable for the training expense allowances
are the following:
1. Items applicable for the expense allowances
(1) Hourly rate of the trainers
(2) Miscellaneous training expenses
(3) Material expenses
(4) Administration expenses
2 Methods applicable for the expense allowance:
(1) The calculation of the hourly fees of the trainers and the
administration expenses is based on one class as the computation unit, those
classes with fewer than the basic number of trainees (fifteen persons) will be
computed with the individual as the computation unit; all other allowances are
computed by each individual.
(2) All the provisions of the allowance are prescribed by the central labor
administration authorities.
Article 5
Resources of the fund for this measure originate from the following:
1. Payable from the employment fund for the physically and mentally
challenged.
2. Payable from the employment fund for the visually challenged.
3. Payable from the budget prescribed by the local government.
4. Payable from the budget prescribed by the central labor competent
authorities.
Article 6
When the handicapped voluntarily leaves the training or is dismissed
from the training during the training program, the training institution
shall return, in proportion, the remaining part of the training expense
allowance to the competent authorities.
The expense allowance for the vocational training of the handicapped, is
applicable once within a period of two years.
Article 7
The institutions which take part of the vocational training for
the handicapped and are recipients of the expense allowances, the allowance
request, accounting, balance reports and cancellations, among other matters,
shall be dully processed according to the relevant regulations.
Article 8
These measures shall take effect on the day of promulgation.
