1. 1999.09.15 MEASURES OF MANAGEMENT AND UTILIZATION OF THE EMPLOYMENT FUND FOR THE VISUALLY CHALLENGED
Article 1
These measures are promulgated according to Item 3 of Article 65
in the Handicapped Protection Law (herein as the Law).
Article 2
The management and utilization of the employment fund for the
visually challenged (herein as the Fund), shall be carried out according to
the rules in this measure, except regulated in other regulations.
Article 3
This Fund is a special fund specified by in the incise 2 of Item 1
in Article 4 of the Budget Law, which is under the employment security fund,
and is the secondary budget of the attaching units budgets, and its
competent authority is the Council of Labor Affairs of the Executive Yuan.
Article 4
Resources of the fund originate from the following:
1.Income of the fine regulated in Item 1 and Item 2 of Article 65 in this
Law.
2.The amount transferred from the employment security fund calculation
procedure.
3.The interest income produced by this Fund.
4.Other related income.
Article 5
The usage of this Fund is as the following:
1.To assist or pay for the vocational training for the visually challenged.
2.To assist or pay for the employment services and arrangements for the
visually challenged.
3.To pay for the business loan planned by the visually challenged.
4.To assist the establishment and operation of the model massage center (
institute) for the visually challenged.
5.To promote other related issues related to the promotion of employment
for the visually challenged.
6.To pay for the expenses of the management and administration.
7.Other related expenses.
Article 6
This Fund shall be kept in a special account in a national treasury.
However, as to meet with the needs of the operation, and approved by the
Ministry of Finances, it can be deposited in other publicly-owned banks, or to
purchase government bonds.
Article 7
This Fund shall set up a administration committee (herein as the
Committee) for the employment of the visually challenged, it shall install
15 to 19 persons as committee members, each with a working period of two
years; among them, one will be the chief member, this post is occupied
concurrently by the chairperson of the competent authority of this Fund;
others will be recruited by the competent authority of the Fund with the
following posts:
1.One representative from the Secretary of the Executive Yuan.
2.One or two representatives from the Labor Commission of the Executive
Yuan.
3.One representative from the Ministry of Internal Affairs.
4.One representative from the Ministry of Finances.
5.One representative from the Statistics Department of the Executive Yuan.
6.Two representatives from the city or county (city) government.
7.One or two representatives from the outstanding institutions (institutes)
which employ the visually challenged.
8.Four or five representatives from the visually challenged, or the
visually challenged welfare institutions or groups.
9.Two or three experts and scholars.
Article 8
The missions of this Fund are as the following:
1.Auditing of the income, management and utilization of this Fund.
2.Auditing of the yearly budget, final calculations and accounting reports of
this Fund.
3.Appraisal of the operation and execution of this Fund.
4.Auditing of other issues related to the promotion of the employment for the
visually challenged.
Article 9
This Fund will hire one secretary, assigned by a person as a side
job from the competent authority of this Fund, under the command of the
chief member, this secretary will execute all the approved issues and take
care of daily issues of this Fund; all other necessary staff will be
assigned by the competent authority from the vocational training office’s
working staff.
Article 10
This Fund shall convene a member meeting once every six months,
there shall be emergency meeting convened when necessary, will be convened
by the chief member; should the chief member cannot execute his/her job, he/
she shall assign a member to substitute him/her.
All the motions presented in the Fund meetings, shall be passed through the
half of the total number of members, and agreed by half of the members present
in the meeting.
Article 11
All the members and assigned staff shall not enjoy salaries.
However, if the staff is assigned by the vocational training office, but not
belonging to the competent authority, transportation allowances shall be
issued according to the regulation.
Article 12
The planning, the execution and the final calculations of the
budget shall be carried out according to the budget law, accounting law, final
calculation law, auditing law and all related laws and regulations.
Article 13
All the accounting system and operation of this Fund, shall be
set up according to the accounting system regulated in the relevant laws.
Article 14
The income, utilization and accumulated sum of this Fund, shall
be published by the competent authority annually.
Article 15
When there is an extra balance of the yearly budget, it shall
follow the budget procedure to be transferred as funds or processed as the
non-distributed balance.
Article 16
When this Fund is over, it shall prove a closing balance, all the
extra shall be turned over to the national treasury.
Article 17
These measures shall take effect on the day of promulgation.
