1. 2001.10.09 Directions for Reviewing of Work Rules

These directions are enacted in order to assist the competent authorities to handle the requirements pursuant to article 70 of the Labor Standards Act.

The competent authorities shall be attentive to the following items when reviewing work rules:
(1) The words of work rules shall be simple and concise, terms used shall be compliant with the Act.
(2) According to the unequivocal principle of working conditions, the content of work rules shall be comprehensive in accordance with article 70 of the Act, contents of which deems unnecessary are not required to stipulate in work rules.
(3) Follows the fundamental spirit of labor management coordination and cooperation.

The content of work rules of which requires the pre-approval from the labor, reporting and obtaining permission in advance from the competent authority, the business entity shall adopt and attach necessary documentations for reviewing, or to accomplish the requirements according to the regulation. In the case that the content shall be included in work rules, the business entity may consult with the labor to prepare reciprocal documentation and forward for reviewing.

In the case of which the labor has opinion different from the employer on the content of work rules, the competent authority shall be considered in reference in the reviewing process, handling cautiously.

The content of work rules of which are in violation of the laws and, or deems insufficient, the competent authority shall inform the business entity to delete, revise, or interpolate the content of work rules.

In the case of the proportion of the content of work rules of the state-owned business entities of which regulated in accordance with article 84 of the Act, the applicable objects and legal references shall be attentive in enforcement.

Business entities of which with less than 30 employees the work rules shall be reviewed Quasi-legally applicable in accordance with these regulations.

The competent authority shall, with the reference to incumbent statutes and regulations and behaviors in practice, in accordance with the legal authority, to review the content of work rules, according to the following tables.
